A bedroom, bathroom and second kitchen in a Calgary basement does not automatically make it a legal secondary suite. Suite legality in Calgary involves zoning, permits, safety codes, egress and registration — not just what's been built.

What Is a Secondary Suite in Calgary?

A secondary suite is a self-contained dwelling unit within or attached to a single-detached home, semi-detached home or other eligible housing form. It has its own living space, sleeping space, bathroom and kitchen — separate from the main dwelling.

Secondary suites are sometimes called basement suites, in-law suites, mother-in-law suites or mortgage helpers. None of these informal terms tells you whether a suite is legally permitted and correctly built.

Does My Calgary Zoning Allow a Secondary Suite?

Secondary suites may be permitted in several Calgary residential land use districts, including R-C1, R-C2, R-CG and others. But zoning is only the starting point. Confirming that a district allows secondary suites doesn't mean that the suite in the house you're looking at was built legally or meets current requirements.

What Makes a Calgary Secondary Suite Legal?

A legally permitted secondary suite in Calgary must meet requirements that typically include all of the following:

The property's land use designation must allow secondary suites as a permitted or discretionary use.

A development permit from the City of Calgary for the secondary suite must have been issued.

A building permit must have been obtained and the work completed to the permit standard.

Bedrooms in the suite must have windows meeting minimum egress requirements for emergency exit — one of the most common deficiencies in unpermitted suites.

Smoke & Carbon Monoxide Protection

Safety code requirements for interconnected smoke alarms and carbon monoxide detectors must be met.

The suite must have adequate and independent heating that meets Alberta safety code requirements.

Separate Entrance

A secondary suite generally requires a separate entrance from the main dwelling.

Depending on the property and zoning, additional off-street parking may be required.

Secondary suites must be registered on the City of Calgary's secondary suite registry.

How Do I Know if a Calgary Basement Suite Is Legal?

The most direct method: check the City of Calgary's secondary suite registry. A suite registered on the registry has gone through the City's process.

If a suite isn't in the registry, that doesn't necessarily mean it was never permitted — permits pre-date the registry, and records aren't always complete. But an unregistered suite warrants further investigation before relying on it.

Don't rely on how the suite appears in an MLS® listing. Terms like "suite," "illegal suite," "mother-in-law suite," "mortgage helper" or "income potential" don't confirm legal status. Verify directly with the City if suite legality affects your buying decision.

Can I Build a Backyard Suite in Calgary?

Possibly. Backyard suites — also called garage suites or garden suites depending on configuration — may be accommodated under several Calgary residential land use districts, subject to the current Land Use Bylaw and the specific property.

Factors affecting whether a backyard suite is feasible on a specific Calgary property include:

A large backyard is not evidence that a backyard suite can be built there. The City's rules on setbacks and coverage often constrain what's achievable on a specific site more than the lot size itself.

Can I Have Both a Secondary Suite and a Backyard Suite?

Potentially, depending on the land use designation, property characteristics and current City requirements. If multiple rental units are part of your investment rationale, verify the actual development potential before purchasing. Don't build the financial plan first and investigate the zoning afterwards.
